U.S. Citizenship and Immigration Services Proposes Rule That Would Impose a Fee for Certain H-1B Petitions
On Aug. 25, 2026, U.S. Citizenship and Immigration Services (USCIS) published a , with a 30 day comment period. If finalized as written, the new rule would impose a $103,265 fee, per H petition, which the Department of Homeland Security indicates is designed to be an interagency cost-recovery fee. The fee would be payable at the time the petition is filed. This proposed rule would not apply to cap-exempt employers, such as 91视频 (91视频).
For people working at 91视频 or planning to work in higher education, this rule would not change the cost or process. It likely will impact private sector hiring decisions as it would apply to all cap-subject H petitions.
